Gem Referral Program Terms and Conditions

Effective for Qualified Referrals (as defined below) submitted on or after February 12, 2025.

These Terms and Conditions (the “Terms”) apply to Gem’s Referral Program (the “Program”). By submitting a referral or otherwise participating in the Program, you agree to be bound by these Terms, Gem’s Terms of Service, and Gem’s Privacy Policy. These terms may be modified at Gem's discretion, with continued participation constituting acceptance of any such modifications.

Eligibility Requirements

Gem employees, consultants, investors, and fans in the United States who refer a US-based company or staffing agency may be eligible to receive up to a $400 bonus payout. 

Who is Not Eligible to Participate?

  • Employees of Gem partners with existing referral programs, including their immediate family and household members;

  • Gem employees within the sales organization, customer success organization, or executive team, including their immediate family and household members;

  • Individuals responsible for making their own HR systems purchasing decision referring their own company; and

  • Individuals who are under 18 years old.

Referral Submission Process

All referrals must be submitted through the official referral form located at www.gem.com/ga/gem-referrals, with all required fields completed in full. The submission must include accurate and current contact information for the referred party. Any incomplete or inaccurate submissions will be deemed invalid and ineligible for rewards.

A Qualified Referral is a new prospect company or staffing agency who is not currently a Gem customer and has not engaged with Gem's sales team within the previous three months. A Qualified Referral must represent a legitimate business opportunity and maintain appropriate authority within their organization. Self-referrals, including referrals of one's own organization or its subsidiaries, are strictly prohibited.

Reward Distribution

Upon successful qualification of a referral, both the referrer and referred customer will receive formal confirmation of the reward, as specified in the Reward details available here. The standard processing period for rewards is up to eight weeks from the date of qualification. Rewards may be distributed through third-party platforms and are subject to their respective terms and conditions (i.e. Visa rewards card or similar).

Tax Implications

All rewards earned through the Referral Program may constitute taxable income under applicable law. Participants bear sole responsibility for any tax obligations arising from their participation in the program. Gem reserves the right to report earned income to relevant tax authorities as required by law.

Program Administration

Gem maintains exclusive authority to modify reward structures, eligibility criteria, and program terms at its discretion. The company reserves the right to suspend or terminate the program with notice to participants. All referrals undergo thorough review for qualification, and Gem's determination of eligibility is final and binding. Personal information collected through the Referral Program is governed by Gem's Privacy Policy. These terms constitute the complete legal agreement between participants and Gem regarding the Referral Program. Offer void where prohibited by law. 

Termination Rights

Gem reserves the unilateral right to suspend or terminate the Referral Program at any time, with or without cause, upon notice to participants. Additionally, Gem may terminate individual participation in the program for any violation of these terms or for any activity deemed detrimental to the program's integrity.
